The purpose of this presentation is to provide an overview of the Computer Fraud and Abuse Act, its history, an explanation of its purpose and an (oversimplified) explanation of what it prohibits. I will then provide examples of how, given the great many ways the CFAA has been used, it applies to many different fields of law and is something that attorneys in all practice areas should be familiar with. I will then cover some of the particulars involved in bringing a CFAA claim, the primary areas of contention that are often disputed in court, and conclude with a look at the data breach and privacy issues that now implicate the CFAA as well as the proposed amendments to it that are currently being debated in Congress.
Finally, for the question that I know everyone is thinking, yes, there will be a Powerpoint presentation! The real question is, however, how many corny pictures of the Scales of Justice will be included? You’ll just have to come and find out for yourself!
